Preamble

THE VINTAGE ICONS is a limited liability company engaged in the sale of pre-owned luxury jewelry, accessories, leather goods, and clothing, branded or unbranded.

THE VINTAGE ICONS operates a retail boutique located at 9 rue d’Alger, Cannes (06), France.

These General Terms and Conditions of Sale exclusively govern distance sales of items offered by THE VINTAGE ICONS on its website www.thevintageicons.com and in its boutique.

They apply to the exclusion of any other terms, in particular those applicable to in-store sales or proposed by the buyer.

THE VINTAGE ICONS reserves the right to modify these General Terms and Conditions at any time. The updated version shall apply as soon as it is published online.

Article 1 – Legal Capacity

Any order placed implies full acceptance of these General Terms and Conditions.

The non-professional buyer declares that they have the legal capacity to enter into this contract, namely:

  • being of legal age;

  • not being subject to guardianship, curatorship, or any other adult protection measure.

Professional buyers declare that they are duly registered with the Trade and Companies Register or the Trade Directory and are not subject to any restriction preventing them from conducting business.

Article 2 – Prices

2.1 Prices are valid only within the period of validity of the offer and subject to item availability, it being specified that THE VINTAGE ICONS sells unique pieces only.

2.2 THE VINTAGE ICONS reserves the right to change its prices at any time; however, items will be invoiced at the price in force at the time the order is confirmed.

2.3 Prices are indicated in euros, all taxes included, excluding processing and shipping costs.

2.4 For orders shipped outside mainland France, the customer becomes the importer of the items concerned.
For shipments outside the European Union and French overseas territories, prices are invoiced exclusive of taxes. Customs duties, local taxes, import duties, or state taxes may apply and are the sole responsibility of the customer.
The customer is responsible for declaring and paying such charges and for verifying the legality of importing the ordered items into the destination country.

Article 3 – Orders

3.1 Orders may be placed via www.thevintageicons.com or by phone, upon identification (name, address, email).
The customer must provide both billing and delivery addresses.
Contractual information is presented in French and confirmed at the time of order validation.

3.2 – Order Registration
By clicking “Order”, the customer fully accepts the order and these General Terms and Conditions. Order validation constitutes acceptance of prices and terms. The order summary may be printed and retained.

3.3 – Order Confirmation
An order confirmation email will be sent, summarizing the total amount charged (including shipping), delivery address, and payment and delivery terms. This confirmation constitutes acceptance of the order and completion of the transaction.

Article 4 – Payment Terms

4.1 All items are payable in full at the time of order.

4.2 Payments are made by credit card (secure SSL payment) or bank transfer.

4.3 Payments are secured via SSL encryption. Credit card details are never stored on our servers.
Accepted cards include Visa, MasterCard, Maestro, Visa Electron, via Stripe, PayPal, and Shopify.

4.4 The card is charged upon order validation.

4.5 Items remain the property of THE VINTAGE ICONS until full payment is received.
Risk of loss or damage transfers to the customer upon physical receipt of the items, or upon handover to a carrier chosen by the customer.

Article 5 – Availability

THE VINTAGE ICONS sells unique items only.
Due to global availability and potential simultaneous orders, an item may no longer be available at the time the order is received.

THE VINTAGE ICONS reserves the right to refuse an order in such cases and undertakes to inform the customer within 14 business days.
The customer may request cancellation or exchange by email.
If cancellation occurs, a refund will be issued within 14 business days.

Article 6 – Delivery

6.1 Shipping Method

Delivery is handled by a carrier chosen by THE VINTAGE ICONS.
Any alternative carrier requested by the customer is at their own risk.
THE VINTAGE ICONS is not responsible for losses caused by a customer-selected carrier or returns marked “undeliverable”.

Any reshipment incurs new shipping costs.

6.2 Delivery Time & Transfer of Risk

Delivery complies with Articles L216-1 to L216-6 of the French Consumer Code.
Delivery occurs within the indicated timeframe or no later than 30 days.

6.3 Order Tracking

A shipment confirmation email with tracking details is sent upon dispatch.
Delays not attributable to THE VINTAGE ICONS or due to force majeure do not give rise to compensation.

6.4 Insurance

Given the value of certain items, shipping insurance is automatically applied.
In case of loss, reimbursement is processed after carrier compensation.

Article 7 – Returns & Refunds

7.1 Right of Withdrawal

Customers have 14 days from receipt to exercise their right of withdrawal.
Notification must be sent by clear written statement or via the withdrawal form.
Acknowledgment will be sent by email.

7.2 Return of Items

Returns must be made within 14 days of withdrawal notification.
Return costs are borne by the customer.
Items must be returned in original or equivalent packaging, in perfect condition, to:

7.3 Refunds

Refunds apply to the product price only, excluding shipping costs, and are processed after receipt of the items.
Failure to collect a parcel does not constitute a refund request.
No refunds are accepted after the legal withdrawal period without express agreement.

Article 8 – Warranties

Given the nature of pre-owned items, no specific warranty is provided.

Article 9 – Inspection of Delivered Items

The customer must inspect items upon receipt.
Any claim for apparent defects or non-conformity must be made within 2 business days by email prior to any return.

Article 10 – Disputes

These General Terms and Conditions are governed by French law.
The French language prevails.
French courts have exclusive jurisdiction.

Article 11 – Personal Data

Personal data is necessary for order processing and customer relations.
In accordance with applicable data protection laws, customers have rights of access, rectification, and objection.

Requests must be sent by email or post, accompanied by proof of identity. A response will be provided within 2 months.
